Welcome to TLMS Power Tools. By accessing our website, purchasing our plugins, or hiring our specialized services (“TutorLMS Fix”), you agree to the following terms.

PART 1: TERMS OF SERVICE

1. Acceptance of Terms

By using our Site or Services, you agree to these terms. If you do not agree, please do not use our services. We reserve the right to modify these terms at any time without prior notice.

2. Digital Products (Plugins)

  • Delivery: Downloadable products are accessible immediately after payment verification.

  • License: All our plugins are licensed under the GNU GPL v2 or later.

  • Automatic Renewals: Licenses are billed annually on a subscription basis. Your subscription will automatically renew at the end of the term unless cancelled. You may cancel auto-renewal at any time from your account dashboard.

  • License Expiration: If you cancel your subscription, your license key will remain valid until the end of the paid period. After expiration, the plugin will continue to function (Lifetime Usage), but you will lose access to updates, security patches, and premium support.

3. Professional Services (“TutorLMS Fix”)

If you hire us for custom development, troubleshooting, or audits:

  • Access: You agree to provide necessary access (WordPress Admin, FTP/Hosting) to perform the work.

  • Backups: You are solely responsible for backing up your website before we begin work. While we take extreme care, TLMS Power Tools is not liable for any data loss or website downtime during the repair process.

  • Scope of Work: The fee covers only the specific issues agreed upon in the invoice. Additional requests or “scope creep” will require a separate quote.

  • Non-Refundable: Unlike our digital products, fees for professional services are non-refundable once the work has commenced, as this covers our time and labor.

4. Payments & Security

  • We use Stripe and PayPal as our secure payment processors.

  • We do not store or have access to your full credit card number. All sensitive financial data is processed directly by the payment gateway servers.

  • By purchasing, you authorize us to charge your payment method for the initial amount and any recurring subscription fees (if applicable).

5. Refund Policy (30-Day Guarantee)

  • Plugins: We offer a risk-free 30-Day Money-Back Guarantee for new plugin purchases. If the plugin does not work for you and our support cannot resolve the issue, we will issue a full refund.

  • Services: As stated in Section 3, consulting and development services are non-refundable once work has started.

  • Abuse: We reserve the right to deny refunds to users who abuse this policy (e.g., downloading the plugin and immediately asking for a refund without a technical reason).

6. Support Policy

  • Support is provided via our official help desk/email for active license holders.

  • We commit to replying within 24-48 business hours.

  • We do NOT provide support for: 3rd party plugin conflicts unrelated to our code, customized code added by the user, or issues on localhost/local environments.

7. Limitation of Liability

To the maximum extent permitted by law, TLMS Power Tools shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our products or services. Our software is provided “as is” without warranty of any kind.

PART 2: PRIVACY POLICY

1. Information We Collect

  • Account Data: Name, email address, and billing address (required for tax/invoicing).

  • Technical Data: When you activate a license, we may collect your website URL and WordPress version to validate the key and push updates.

  • Usage Data: IP address, browser type, and site interactions (via cookies).

2. How We Use Your Data

  • To process transactions and prevent fraud (Stripe/PayPal).

  • To deliver product updates and verify license validity.

  • To provide technical support.

  • To send transactional emails (invoices, password resets, renewal reminders).

3. Data Sharing & Third Parties

We take your privacy seriously. We never sell your data. We only share data with essential infrastructure providers:

  • Stripe/PayPal: For payment processing.

  • Email Service Provider: To send you purchase receipts and license keys.

  • Google Analytics: For anonymous site usage statistics.

4. Cookies

We use cookies to keep you logged in and to remember your cart contents. You can disable cookies in your browser, but some site features may not function correctly.
